C. Robinson has begun removing carriers from its network based on FMCSA safety scores, according to notifications sent to affected operators. The notices indicate carriers exceeding intervention thresholds in the broker's scoring model lose access to book loads on Navisphere Carrier and through aligned representatives, effective immediately. In-transit loads continue to completion and payment, but new freight bookings are blocked until BASIC scores improve to acceptable levels. The timing of the eligibility change follows a May 14 Supreme Court ruling in Montgomery v. Caribe Transport II, LLC. The unanimous 9-0 decision clarified that state-law negligent hiring claims against freight brokers are not preempted by the Federal Aviation Administration Authorization Act. Industry observers suggest the ruling may prompt brokers to reassess carrier risk exposure in real time given expanded legal liability.
