Capital One Sues Unknown Defendants Over Trademark Misuse in Fraud Schemes

Capital One filed a lawsuit Tuesday in the U.S. District Court for the Eastern District of Virginia against 10 unidentified persons and entities accused of operating large-scale scam campaigns that misuse the bank's trademarks. The defendants allegedly conduct robocall and telemarketing operations impersonating Capital One and Discover representatives. They use prerecorded messages warning of suspicious charges and requesting consumers verify transactions or personal information. The lawsuit alleges the fraudsters deliberately misled and deceived consumers nationwide using the CAPITAL ONE and DISCOVER trademarks. Capital One is leveraging trademark and false advertising law to pursue the case. Company officials say the litigation provides an offensive strategy to obtain discovery information that could help identify the scammers. Chad Miller, vice president of fraud strategy and analysis at Capital One, characterized the action as playing offense against fraud operators.
