The Federal Motor Carrier Safety Administration submitted its broker transparency rulemaking to the White House Office of Information and Regulatory Affairs on August 27, advancing the proposal through its final internal checkpoint before public release. The rule, designated RIN 2126-AC63 and docket FMCSA-2023-0257, would amend regulations governing property broker records under 49 CFR Part 371. OIRA classified the proposal as not economically significant with no legal deadline attached. The submission marks the first substantive movement since the comment period closed in March 2025, ending what appeared to be a prolonged delay. Under Executive Order 12866, OIRA has up to 90 days to complete its review, though non-economically significant rules typically move faster. For stakeholders, the OIRA review window represents the last opportunity to request meetings and make their case before the text is fixed for public comment in the Federal Register.
