The Greenbrier Companies has rejected a U.S. Customs and Border Protection determination that it evaded antidumping duties on freight rail couplers sourced from Mexico and China. CBP's May 18 enforcement notice, filed under the Enforce and Protect Act in Case 8183, found that Greenbrier imported couplers subject to duty orders without declaring the shipments or applying required cash deposits. The agency will suspend affected entries and require formal documentation and duty payments going forward. Greenbrier countered that CBP's decision ignores the realities of North American rail operations, where freight cars regularly cross borders between carriers under common-carrier obligations. The company maintains the ruling disconnects from how the continental interchange system—spanning more than 80 years—actually functions.
