A nine-person jury will begin deliberating Monday in the first phase of Elon Musk's lawsuit against OpenAI, CEO Sam Altman and President Greg Brockman over the company's conversion to a for-profit structure. The trial concluded Thursday in Oakland federal court after closing arguments. Judge Yvonne Gonzalez Rogers will make the final liability determination, as the jury's verdict will be advisory. Musk claims the approximately $38 million he donated to OpenAI was used for unauthorized commercial purposes after the company abandoned its nonprofit status. His legal team argued OpenAI failed to open-source technology and prioritize safety. OpenAI's attorneys countered that Altman and Brockman never committed to maintaining nonprofit status and that donations were properly spent. The second phase addressing remedies also begins Monday.
