Both sides have now made their case to the Fifth Circuit Court of Appeals in a high-stakes liability dispute with potentially enormous consequences for broker and carrier responsibilities. Meyer's estate filed a brief last week opposing Penske's request for an en banc hearing, after the appellate court overturned a district court victory for the Penske companies. The case stems from a fatal December 2018 crash on Highway 202 in Bee County, Texas, that killed Lyndon Dean Meyer. Penske Logistics contracted with Adient to transport car seats, routing the freight through its brokerage affiliate Penske Transportation Management to Liberty Lane, which then subcontracted to OK Trans. An OK Trans driver struck Meyer's vehicle. The Fifth Circuit ruled that Penske Logistics bore liability for the driver's actions, a finding that has generated significant concern throughout the trucking and logistics sectors regarding supply chain accountability.
