New Orleans Attorney's Appeal Denied as Murder Trial Looms in Staged Accident Scheme

A federal judge has rejected Vanessa Motta's request for a new trial, closing one avenue of appeal for the New Orleans attorney convicted in March of orchestrating an elaborate staged accident insurance fraud operation. Motta and co-defendant Jason Giles led the conspiracy that generated fake collisions between vehicles and commercial trucks to trigger insurance payouts. The King Law Firm, where Giles was employed, and conspirator Daiminike Stalbert also faced conviction on related charges.

The ruling by U.S. District Court Judge Wendy Vitter clears the way for prosecutors to pursue parallel litigation. A murder trial begins August 10 against Sean Alfortish, Motta's romantic partner during the scheme, and Leon Parker. Both men face charges in the September 2020 death of Cornelius Garrison, a scheme participant who agreed to cooperate with federal investigators.

Although Motta was never charged in connection with Garrison's murder, her appeal request cited the government's threat to introduce evidence of her involvement in or acquiescence to the killing. She argued that certain procedural steps could have prevented this threat from affecting her trial. Operation Sideswipe ultimately charged more than 60 individuals on mail and wire fraud offenses.
