STB Accepts Revised UP-NS Merger Application, Pauses Review Process

The Surface Transportation Board unanimously accepted a revised merger application from Union Pacific and Norfolk Southern on May 28, 2026, but suspended proceedings to demand additional documentation. The carriers submitted their revised filing April 30 after regulators rejected their initial application for lacking required information under 49 C.F.R. part 1180. STB Chair Patrick Fuchs, Vice Chair Michelle Schultz and Member Karen Hedlund determined the applicants provided sufficient data to meet completeness standards. However, the Board found several unclear and underdeveloped aspects requiring supplementation. The STB ordered the carriers to submit supplemental information by July 27, 2026, citing the need for thorough public interest evaluation and adequate commenting opportunities. Environmental review remains suspended pending the companies' response.
