The Surface Transportation Board denied three motions seeking summary rejection of the Union Pacific-Norfolk Southern merger proposal. BNSF Railway, CSX, and a shipper coalition filed motions in August arguing the carriers failed to meet initial evidentiary standards. Opponents contended the Committed Gateway Pricing program was insufficient to enhance competition and that operational integration plans were inadequate. UP and NS countered that their application met threshold requirements by presenting facts supporting public interest benefits in the most favorable light. The board determined that a complete evidentiary record would better inform its decision on this precedent-setting case—the first major merger review under 2001 STB rules. Opening comments are due in November, allowing parties to advance full arguments on the transaction's merits.
