Texas has resumed issuing non-domiciled commercial driver's licenses to temporary agricultural workers following federal approval. The Texas Department of Public Safety began processing applications Monday for individuals holding H-2A visa status. The move marks a reversal of a suspension imposed earlier this year as state officials reviewed compliance with new Federal Motor Carrier Safety Administration requirements.
Current authorization covers only H-2A visa holders, with guidance for H-2B and E-2 visa applicants expected later. Applicants must appear in person, providing valid foreign passports, visa documentation and proof of H-2A status. Licenses cannot exceed one-year validity periods.
The state estimated between 6,000 to 9,600 non-domiciled CDL holders operate in Texas. Nine states including North Dakota, South Dakota, Iowa, Delaware, Utah, Rhode Island, Minnesota, and New Jersey have received federal approval to resume programs. Several others including California and Washington continue reassessing compliance. Federal officials project 97 percent of current non-domiciled CDL holders nationwide will be ineligible for renewal.
