TQL filed three motions Monday seeking dismissal of a racketeering case brought by carriers in federal court in Texas. The 3PL argued its business practices do not constitute corrupt activity under RICO law and contended the case belongs in Ohio state court. Carrier agreements with TQL, including those with Stevens Trucking, Western Flyer Express, Christenson Transportation and E., specify disputes must be litigated in Clermont County, Ohio courts under Ohio law, TQL stated in filings. The company also moved to remove IWS Motor Freight from the lawsuit, asserting the carrier maintained no direct contract with TQL and conducted no business with the 3PL. C. Robinson, the other defendant named in the RICO action, has not yet filed a response. TQL targeted both procedural grounds and the substantive definition of alleged unlawful conduct in its filings.
