The Small Business in Transportation Coalition filed a federal court petition June 10 challenging the commercial driver's license programs of New York and California. The coalition seeks to strip both states of their CDL issuance authority, arguing the Federal Motor Carrier Safety Administration has already determined both states are in substantial noncompliance with federal regulations, triggering mandatory decertification under law. The petition specifically challenges FMCSA's April 16 determination regarding New York and contests the agency's failure to act on a May 2025 decertification request. The lawsuit references a May 29 fatal bus crash on Interstate 95 in Virginia that killed five people, alleging the driver held a New York CDL despite English-language proficiency concerns. The bus operator, E&P Travel Inc., faces federal scrutiny regarding its network connections. The driver faces five felony involuntary manslaughter charges.
