A federal judge in Colorado granted Total Quality Logistics' motion to dismiss it from a wrongful death case Tuesday. Deann Miller sued multiple defendants after her husband, Scott Miller, was killed in June 2024 when steel beams fell from a truck onto his pickup on U.S. 285. Judge Nina Wang found insufficient evidence linking TQL to the fatal incident, ruling it was unclear which company driver Ignacio Cruz-Mendoza worked for at the time.
The judge also dismissed Intsel Steel West and Triple-S Steel Holdings from the case. Judge Wang said Cruz-Mendoza may have been delivering cargo on behalf of Monique Trucking.
The dismissals carry no prejudice, allowing Miller to refile with additional legal arguments. TQL had initially cited federal preemption as a defense before withdrawing that claim following recent Supreme Court precedent.
