Pink Cheetah, TQL Clash Over Broker Disclosure Rules as Federal Rulemaking Nears Completion

A federal appeals court heard arguments last week in a dispute between freight broker TQL and carrier Pink Cheetah over documentation transparency requirements. The case centers on whether a lower court improperly dismissed Pink Cheetah's complaint alleging TQL failed to provide adequate disclosures. Pink Cheetah's counsel argued the 2023 dispute predates current federal rulemaking efforts and should be evaluated independently. TQL countered that a proposed FMCSA broker transparency rule—six years in development—should influence the court's analysis, particularly regarding contractual waivers between brokers and motor carriers. The proposed rule completed its public comment period last year and is in final stages at the White House Office of Information and Regulatory Affairs. The D.C. Court of Appeals panel heard oral arguments for approximately 20 minutes.
