The Surface Transportation Board has widened its review of Union Pacific and Norfolk Southern's proposed merger to examine potential retaliation against shippers who speak publicly about the combination. The STB is requiring Union Pacific to produce a conference video featuring Jim Vena and related records concerning possible intimidation of customers. Union Pacific has denied making threats against shippers. Regulators have not yet determined whether intimidation occurred or whether the merger review should proceed. The outcome could influence whether federal officials approve the deal.
